href=\"https:\/\/profesionisti.juridice.ro\/vlad-stefan\" target=\"_blank\" rel=\"noopener\">Vlad \u0218tefan<\/a>, specializa\u021bi \u00een materia contenciosului administrativ \u0219i \u00een dreptul \u00eenv\u0103\u021b\u0103m\u00e2ntului, au ob\u021binut o solu\u021bie de referin\u021b\u0103 cu privire la natura de act administrativ a\u00a0<strong>Raportului scris final<\/strong>\u00a0<strong>al inspec\u021biei \u0219colare generale<\/strong>\u00a0\u0219i, implicit, cu privire la\u00a0<strong>posibilitatea contest\u0103rii acestuia \u00een fa\u021ba instan\u021belor de judecat\u0103<\/strong>.<\/p><p>Prin solu\u021bia definitiv\u0103 pronun\u021bat\u0103, Curtea de Apel Ploie\u0219ti a casat solu\u021bia primei instan\u021be \u0219i a validat interpretarea SGA, re\u021bin\u00e2nd urm\u0103toarele:<\/p><p><em>\u201eDin coroborarea acestor dispozi\u021bii legale rezult\u0103 c\u0103 raportul contestat constituie act administrativ \u00een sensul reglementat de art. 2 alin. 1 lit. c din Legea nr. 554\/2004 \u00eentruc\u00e2t este emis de o autoritate public\u0103, respectiv de p\u00e2r\u00e2tul Inspectoratul \u0218colar Jude\u021bean _____, \u00een regim de putere public\u0103, respectiv \u00een exercitarea unor atribu\u021bii de control al activit\u0103\u021bii desf\u0103\u0219urate de unitatea de \u00eenv\u0103\u021b\u0103m\u00e2nt supus\u0103 controlului, ce s-a finalizat prin atribuirea unor calificative \u0219i obligarea recurentei reclamante la elaborarea unui plan de \u00eembun\u0103t\u0103\u021bire a activit\u0103\u021bii \u00een conformitate cu disp. art.36 din Regulamentul de inspec\u021bie, ne\u00eendeplinirea m\u0103surilor dispuse \u00een cuprinsul acestora sau \u00eendeplinirea necorespunz\u0103toare, put\u00e2nd duce la sesizarea ARACIP, \u00een vederea demar\u0103rii de c\u0103tre aceast\u0103 institu\u021bie a procedurilor de evaluare extern\u0103 periodic\u0103 sau, dup\u0103 caz, de control al calit\u0103\u021bii.<\/em><\/p><p><em>Prin urmare, \u00een mod gre\u0219it a re\u021binut prima instan\u021b\u0103 c\u0103 respectivul raport constituie doar act preparatoriu, pe motiv c\u0103 nu ar produce efecte juridice prin el \u00eensu\u0219i, de vreme ce, din cuprinsul acestuia rezult\u0103 c\u0103 institu\u021bia de \u00eenv\u0103\u021b\u0103m\u00e2nt a primit ni\u0219te calificative ce impun elaborarea unui plan de \u00eembun\u0103t\u0103\u021bire a activit\u0103\u021bii.<\/em><\/p><p><em>Ca atare, \u00eensu\u0219i textul legal confer\u0103 caracter executoriu acestui raport de control, de vreme ce impune efectuarea unui plan de \u00eembun\u0103t\u0103\u021bire a activit\u0103\u021bii ce trebuie aprobat de inspectorul coordonator \u0219i aplicat de unitatea de \u00eenv\u0103\u021b\u0103m\u00e2nt, astfel c\u0103 acesta poate fi contestat \u00eenainte de verificarea \u00eendeplinirii obiectivelor asumate \u00een cadrul planului.\u201d<\/em><\/p><p>Pe aceast\u0103 cale, interpretarea instan\u021bei se prezint\u0103 ca un prim fundament \u00een tran\u0219area unui lung \u0219ir de controverse ap\u0103rute \u00een practic\u0103.
